1. Who we are

architour organ­ises archi­tec­ture tours, talks and audio tours in the Neth­er­lands. We work mainly for busi­ness cli­ents, often through inter­me­di­ar­ies such as travel agen­cies, tour oper­at­ors and DMCs. architour vof is the con­trol­ler for the pro­cessing of per­son­al data described in this statement.

2. Who this state­ment applies to

This state­ment applies to every­one whose per­son­al data we pro­cess: con­tact per­sons at cli­ents and inter­me­di­ar­ies, par­ti­cipants in tours and talks, guides and oth­er part­ners, news­let­ter recip­i­ents and vis­it­ors to architour.nl.

3. What data we pro­cess, why, and for how long

We only pro­cess the data we need for a spe­cif­ic pur­pose. Below you can read, for each activ­ity, which data is involved, on which leg­al basis under the Gen­er­al Data Pro­tec­tion Reg­u­la­tion (GDPR) we pro­cess it and how long we keep it.

Enquir­ies and quotes

When you con­tact us via the con­tact form, by email or by phone, we pro­cess your name, the name of your organ­isa­tion, your email address and phone num­ber, and details of the reques­ted tour such as date, num­ber of par­ti­cipants and wishes. We use this data to answer your enquiry and pre­pare a quote. As our cli­ents are organ­isa­tions, we do so on the basis of our legit­im­ate interest in com­mu­nic­at­ing with (pro­spect­ive) busi­ness cli­ents. If you are a sole trader, the leg­al basis is tak­ing steps pri­or to enter­ing into a con­tract. If an enquiry does not lead to an assign­ment, we delete your data 24 months after the last contact.

Pre­par­ing and run­ning tours

To organ­ise a tour, we usu­ally only need the name and con­tact details (phone and email) of a con­tact per­son or group lead­er, the num­ber of par­ti­cipants and the pro­gramme. Occa­sion­ally, build­ing own­ers or archi­tec­ture firms require a list of par­ti­cipants’ names for a vis­it. Only in that case do we ask for such a list.

We pro­cess this data to carry out the agreed tour. The leg­al basis is the per­form­ance of the con­tract with the cli­ent. For the data of con­tact per­sons and par­ti­cipants, who are not them­selves party to the con­tract, the leg­al basis is our legit­im­ate interest in per­form­ing that con­tract. We delete par­ti­cipant lists and oth­er oper­a­tion­al data no later than 6 months after the tour.

Diet­ary and access­ib­il­ity needs

When we book a res­taur­ant for a group or adapt the pro­gramme, we prefer­ably only ask for num­bers, without names, for example “two people glu­ten-free”. Aller­gies or phys­ic­al impair­ments linked to a named per­son are health data. We only pro­cess such data with the expli­cit con­sent of the per­son con­cerned and delete it no later than 1 month after the tour.

Pho­tos taken dur­ing tours

We only pub­lish pho­tos in which par­ti­cipants can be recog­nised, for example on our web­site or social media, with their expli­cit con­sent. You can with­draw this con­sent at any time; we will then remove the photo as far as it is with­in our control.

Admin­is­tra­tion and invoicing

For invoicing, we pro­cess the name and details of the cli­ent and the con­tact per­son, as well as invoice and pay­ment data. Dutch law requires us to keep our accounts for sev­en years. The leg­al basis is there­fore a leg­al obligation.

Feed­back form

In our feed­back form you can enter your name, organ­isa­tion, the tour loc­a­tion, the guide’s name, a rat­ing and com­ments. We use this inform­a­tion to improve our tours and pass the feed­back on to our guides. The leg­al basis is our legit­im­ate interest in improv­ing the qual­ity of our tours. We keep the responses for 24 months.

News­let­ter

From time to time we send a news­let­ter to busi­ness con­tacts such as travel agen­cies, tour oper­at­ors and pre­vi­ous cli­ents. For this we use name, organ­isa­tion and email address. For exist­ing busi­ness rela­tions, the leg­al basis is our legit­im­ate interest in inform­ing them about our ser­vices; in oth­er cases we ask for con­sent in advance. Each news­let­ter con­tains an unsub­scribe link. After you unsub­scribe, we no longer use your email address for the news­let­ter. We send the news­let­ter via Mailchimp.

Work­ing with guides and suppliers

For the guides and sup­pli­ers we work with, we pro­cess name, con­tact details, arrange­ments and invoices in order to plan and settle assign­ments. The leg­al basis is the per­form­ance of the con­tract. We keep this data for the dur­a­tion of the cooper­a­tion and 24 months there­after; invoices for sev­en years.

Web­site

Our web­site is hos­ted by Host­net in the Neth­er­lands. Each vis­it records tech­nic­al data such as your IP address in serv­er log files. This is neces­sary for a secure and func­tion­ing web­site (legit­im­ate interest). This data is kept in accord­ance with Hostnet’s reten­tion periods.

We use func­tion­al cook­ies that are needed for the web­site to work. Ana­lyt­ics cook­ies from Google Ana­lyt­ics, which we load via Google Tag Man­ager, are only placed if you give your con­sent. When you first vis­it the web­site, a cook­ie ban­ner appears in which you can accept or decline cook­ies or choose per cat­egory. You can change your choice or with­draw your con­sent at any time via the cook­ie set­tings but­ton on the website.

Our web­site con­tains links to our pages on Face­book, Ins­tagram, Linked­In and You­Tube. These are links only, not embed­ded con­tent, so no data is passed on to these plat­forms unless you click a link. If you do, the pri­vacy state­ment of the plat­form con­cerned applies.

4. Data we receive from others

We often receive per­son­al data not from you dir­ectly but from your employ­er, the organ­iser of your trip or an inter­me­di­ary such as a travel agency, tour oper­at­or or DMC. This con­cerns the data lis­ted above, usu­ally only the name and con­tact details of a group lead­er and the num­ber of par­ti­cipants, and occa­sion­ally a list of names for a build­ing visit.

Any­one provid­ing us with par­ti­cipants’ data must be entitled to do so (Art­icle 18 of our Terms and Con­di­tions). We ask cli­ents and inter­me­di­ar­ies to pass this pri­vacy state­ment on to participants.

5. Who we share data with

We only share per­son­al data with parties involved in car­ry­ing out an assign­ment, and only to the extent necessary.

• Guides. Our tours are led by freel­ance guides work­ing on our behalf. They receive, for example, the name and phone num­ber of the group lead­er. They may only use this data for the tour con­cerned, as agreed with them in writing.

• Trans­port com­pan­ies, res­taur­ants and ven­ues. Boat and coach oper­at­ors, res­taur­ants and ven­ues where we make book­ings receive the data they need for their own ser­vices, usu­ally only the num­ber of par­ti­cipants and the name of a con­tact per­son. They are respons­ible for their own pro­cessing of this data.

• Hosts of vis­its. Build­ing own­ers, archi­tec­ture firms and oth­er hosts receive a par­ti­cipant list if they need it to grant access to a building.

• Ser­vice pro­viders. We use a num­ber of ser­vice pro­viders who pro­cess data on our behalf (see sec­tion 6). We have data pro­cessing agree­ments with them.

• Pub­lic author­it­ies, where we are leg­ally obliged to do so.

We do not sell per­son­al data.

6. Our ser­vice providers

We work with the fol­low­ing ser­vice pro­viders: Host­net (Neth­er­lands) for web­site host­ing and email, Exact Online (Neth­er­lands) for account­ing and invoicing, Mailchimp (The Rock­et Sci­ence Group LLC, United States) for send­ing our news­let­ter, and Google (Google Ana­lyt­ics and Google Tag Man­ager) for web­site stat­ist­ics, only if you have giv­en your consent.

7. Trans­fers out­side the European Eco­nom­ic Area

Mailchimp and Google may pro­cess data in the United States. Such trans­fers take place on the basis of the EU-US Data Pri­vacy Frame­work, in which Mailchimp and Google par­ti­cip­ate, or the European Commission’s stand­ard con­trac­tu­al clauses. All oth­er data is pro­cessed with­in the European Eco­nom­ic Area.

8. Secur­ity

We take appro­pri­ate tech­nic­al and organ­isa­tion­al meas­ures to pro­tect your data, such as secure con­nec­tions, restric­ted access to data and pass­word protection.

9. Do you have to provide data?

Without the details of a con­tact per­son and the num­ber of par­ti­cipants, we can­not organ­ise a tour. Oth­er data, such as in the feed­back form, is provided vol­un­tar­ily. We do not use auto­mated decision-mak­ing or profiling.

10. Your rights

You have the right to access your data, to have it cor­rec­ted or erased, to restrict its pro­cessing and to data port­ab­il­ity. You can object to pro­cessing based on our legit­im­ate interest. Where you have giv­en con­sent, for example for cook­ies, the news­let­ter or pho­tos, you can with­draw it at any time.

Please send your request to info@architour.nl. We will respond with­in one month. To pre­vent mis­use, we may ask you to veri­fy your identity.

If you are not sat­is­fied with how we handle your data, you can lodge a com­plaint with the Dutch Data Pro­tec­tion Author­ity, the Autor­iteit Per­soonsgegevens (www.autoriteitpersoonsgegevens.nl).
